F1: Appeal Chances Not Clear, Says Whitmarsh

McLaren’s Martin Whitmarsh admits that it’s not entirely clear what will happen with the team’s attempt to appeal Lewis Hamilton’s Spa penalty.

In theory such decisions cannot be appealed, as set down under Article 152 of the sporting code. The 25sec penalty is, after all, a post-race substitute for a drive-through – which clearly cannot be altered retrospectively.

However, by making an appeal McLaren does at least ensure that the story does not end on Sunday night, as the FIA stewards were obliged to accept it.It now goes to the secretariat of the Court of Appeal, which is independent of the FIA.

“We’ll
find out,” Whitmarsh when asked by SPEEDtv.com whether the appeal was valid. “There’s always some doubt over these things, isn’t there, to be frank about it. We will see shortly.

“We’ve lodged out intention to appeal, because we’ve got no choice. When things like this happen, you’ve got to do something about it. It doesn’t matter what’s happened before, I think you’ve just got to look at the merits of what happened today.”

Whitmarsh is adamant that Hamilton had given up his advantage to Kimi Raikkonen: “Yes, he let him through.”
